10. Punitive Articles

Any person subject to this chapter who fights or promotes, or is concerned in or connives at fighting a duel, or who, having knowledge of a challenge sent or about to be sent, fails to report the fact promptly to the proper authority, shall be punished as a court-martial may direct.

    What happens if you were in a fight but did not swing first?

      Both people are guilty. The old man took me to Mast at 2200 the same day. Busted us both down and gave us 45 days restriction and 45 extra duty. I tell people. Walk away it is not worth it.

      Unless you pace off at 10 yards with sword or pistol of the challenged’s choice i think you’re fine. This is one of those old articles that is somewhat outdated. a fist fight would be found in a different article.

      Tony, Article 114 specifically refers to the ancient practice of dueling, by weapons of choice (pistols, sabers, etc.) which involve a formal challenge and acceptance. Fist fighting and other types of violent conduct are not covered by this article. Thank you for your question.

    Can still be brought up on charges of assault. However depending on the command they may let it go as self defense. Depends on if you provoked the situation.

    In the 1990’s on the FRIGATE, there were more then a few, Deck SN who would handle their differences in the forward locker. Everything was kept in house. Get a bunch of young angry men together doing hard stressful work that is not very fun and dueling will take place. Why don’t they teach the recruits in bootcamp to be nice little children who sing lullabies and never use weapons, if they don’t expect dueling in the ranks, especially only when the similar paygrades are involved. A higher paygrade picking on a lower paygrade is not dueling.

    If another service member (higher, equal or lower) says to me, “do you want to take off blouses and settle this,” are they not propositioning me to a duel?

    You might not get in trouble but your steed is going to be pretty uncomfortable…
